The NYS Office of Cannabis Management recently announced that rules for growing medicinal cannabis at home have been approved.

Home cultivation for personal use

The Cannabis Control Board (CCB) wants the state to establish rules for medical cannabis patients to grow their own plants for personal use. The adoption of the resolution on growing medicinal cannabis at home comes about a year after the draft rules were first proposed and several months after the board approved the revised rules. Now the Office of Cannabis Management (OCM) has ordered formally sent the approved regulations to the New York State Department of State.

A maximum of 6 cannabis plants

In general, the rule allows registered patients and caregivers to grow up to six plants, three of which are mature. They could possess up to five pounds of cannabis derived from those plants, which is in line with the state's adult-use legalization law.

The home cultivation rules for medicinal cannabis patients and caregivers will come into effect on October 5. CCB Chair Tremaine Wright said this development is “an exciting milestone for our medicinal cannabis program”.
OMC Director Chris Alexander said at the end of the hearing that the office has "prioritized patient access to this program" and "will continue to be a priority. "I'm just really excited that we can provide this more affordable option for patients to access that drug."

In order to grow, patients – over the age of 21 – must be enrolled in the cannabis program. One person may cultivate on behalf of a certified patient. When two or more patients live in a household, a maximum of 6 adult cannabis plants may be grown.
